10. ADOPTION OF TENTATIVE DISTRICT EDUCATIONAL FACILITIES PLAN
Description
Section 1013.35, Florida Statutes, establishes a series of facility planning actions with which all Florida School Boards must comply.  Long Range Planning and Budget staff have completed the Department of Education's on-line planning tool and have submitted the draft plan to all local governments for review of Comprehensive Plan consistency.  The School Board is now asked to adopt the plan, which does comply with the financial feasibility requirement.  The first section replicates the revenues and projects in the Board's recently-adopted five-year capital budget; the first year of this section constitutes the capital outlay budget as required in s. 1013.61, F.S.  The Long Range Planning section is unnecessary this year due to the recently adopted five-year plant survey.  The reader should use caution when interpreting this document as some data elements (e.g., remaining revenues, class size, school enrollments, total enrollments, future costs) are misleading due to the spreadsheets' design.  Also, the Board's adoption of this document does not compel any action past the implementation of the Capital Budget for 2012-2016, as previously adopted September 13, 2011.

AGREEMENTS/CONTRACTS

11. APPROVAL OF THE CONTRACT BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA, AND CHILDREN'S THERAPY WORKS
Description
The Individuals with Disabilities Education Act IDEA (2004) requires school districts to set aside a proportional share of their Federal IDEA funds to provide services to students with enrolled in private schools by their parent including McKay Scholarship students.  The services most requested by private schools are speech therapy, occupational therapy and physical therapy.  Since the district does not have direct hire staff available to provide these services, contract with private vendors like Children's Therapy Works are being implemented to meet this requirement.

Recommendation
That the contract for speech therapy, occupational therapy and physical therapy services between the School Board of Sarasota County, Florida, and Children's Therapy Works in an amount not to exceed $65,000, be approved as presented.

12. APPROVAL OF AGREEMENT FOR SERVICES BY INDEPENDENT CONTRACTOR BOYS AND GIRLS CLUB OF SARASOTA FOR THE 21ST CENTURY COMMUNITY LEARNING CENTERS IN NORTH COUNTY
Description
This agreement details the relationship and responsibilities shared by the School Board of Sarasota County and the Community Based Organization (CBO), Boys and Girls Club of Sarasota, to be responsible for full implementation of the 21st Century Community Learning Center (CCLC) program in North County; service to be provided at six (6) school-based sites, CBO and FBO sites as detailed in the Grant.

Recommendation
That the School Board of Sarasota County approve the agreement with Boys and Girls Club of Sarasota County to be responsible for implementing the 21st CCLC program in North County for 2011-2012.

13. APPROVAL OF AGREEMENT FOR SERVICES BY INDEPENDENT CONTRACTOR BOYS AND GIRLS CLUB OF SARASOTA COUNTY FOR THE 21ST CENTURY COMMUNITY LEARNING CENTERS (CCLC) IN SOUTH COUNTY
Description
This agreement details the relationship and responsibilities shared by the School Board of Sarasota County and the Community Based Organization (CBO), Boys and Girls Club of Sarasota County, to provide services as outlined in the 21st CCLC grant for 1112 SY.

Recommendation
That the School Board of Sarasota County approve the agreement with Boys and Girls Club of Sarasota County for 21st CCLC program in South County for 2011-2012, as presented.

EXPULSIONS

14. APPROVAL OF EXPULSION CASE NO. 11-212
Description
On December 10, 2010, the student listed in Expulsion Case No. 11-212, violated School Board Policy 5.34, Disruptive Behaviors to School Setting.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 7, 2012.

Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing have been waived by the student/parent, the recommendation as specified in Expulsion Case No, 11-212, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2011-2012 academic year.

15. APPROVAL OF EXPULSION CASE NO. 11-232
Description

School Board Policy 5.34(4), permits the Board to hold in abeyance the expulsion of a student if the student participates in a recognized alternative-to-expulsion program.  This student is being placed in an alternative school.

That Expulsion Case No. 11-232, be held in abeyance per School Board Policy 5.34.

16. APROVAL OF EXPULSION CASE NO.11-310
Description

The student listed in Expulsion Case No. 11-310, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On April 4, 2011, the student listed in Expulsion Case No. 11-310, violated School Board Policy 5.34(1)(d), Fighting.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 4, 2012.



Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 11-310, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2011-2012 academic year.

17. APPROVAL OF EXPULSION CASE NO. 11-457
Description

The student listed in Expulsion Case No. 11-457, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On April 20, 2011, the student listed in Expulsion Case No. 11-457, violated School Board Policy 5.34(1)(d), Physical Aggression.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 4, 2012.



Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 11-457, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2011-2012 academic year.

Description
On May 3, 2011, the student listed in Expulsion Case No. 11-502, violated School Board Policy 5.34, Disruptive Behaviors to School Setting.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until August 1, 2012.

That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 11-502, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2011-2012 academic year.

Description
The student listed in Expulsion Case No. 11-511, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On May 18, 2011, the student listed in Expulsion Case No. 11-511, violated School Board Policy 5.321, Possession of Weapons and Other Prohibited Articles.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 7, 2012.

Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 11-511, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2011-2012 academic year.

20. APPROVAL OF EXPULSION CASE NO. 12-017
Description
On September 1, 2011, the student listed in Expulsion Case No. 12-017, violated School Board Policy 5.322, Prohibition Against Use, Sale, or Possession of Alcohol or Drugs.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until August 1, 2012.

Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 12-017, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2011-2012 academic year.

MATERIALS MANAGEMENT

21. APPROVAL TO PURCHASE OFFICE AND CLASSROOM FURNITURE ON STATE CONTRACT
Description
The Materials Management Department requests permission to purchase office and classroom furniture from The Hon Company on the State of Florida Furniture Contract #425-001-06-1.  Consolidating purchases under this agreement will result in discounts ranging from 62.3% to 73.3%.  The funds for these purchases are contained in the capital budgets for new construction and individual cost center budgets.      

Recommendation
That the purchase of furniture from The Hon Company, in an amount not to exceed $625,000, be approved for award and purchase.

22. APPROVAL OF CLASSIFICATION OF INOPERATIVE EQUIPMENT AND FURNITURE AS PROPERTY TO BE DELETED
Description
The custodians of the property (cost center heads) have certified it to be traded in on new equipment, unaccounted for, not repairable or otherwise inoperable.  Property still on hand after reallocation will be salvaged for any useful parts and then sold at auction.   

Recommendation
That the classification of equipment and furniture, as property to be deleted, be approved.

CONSTRUCTION

23. APPROVAL AND/OR RATIFICATION OF CONSTRUCTION SERVICES' CHANGE ORDER(S)
Description

The Construction Services' Change Order(s) are summarized on the enclosure for ease of review.  These change orders collectively total a decrease of $775,699.26 in gross contract dollars.

Included in these change orders are $791,218.15 credits for Direct Material Purchases; the corresponding Direct Material Purchase Orders of $746,135.05 result a net of $45,083.10 in sales tax savings.



Recommendation

New Business
24. TERMINATION OF LEASE AGREEMENT AND OPERATING AGREEMENT WITH THE POLICE ATHLETIC LEAGUE
Description
Termination of the lease and operating agreement between the School Board and the Police Athletic League for the Sailor Circus will facilitate a new lease and operating agreement between the School Board and Circus Sarasota.  This termination also clarifies transfer of both equipment and funds directly from the Police Athletic League and Circus Sarasota.

Recommendation
That the Board approve the termination of the lease agreement and operating agreement between the School Board and the Police Athletic League as presented.

25. APPROVAL OF LEASE AGREEMENT AND OPERATING AGREEMENT FOR THE SAILOR CIRCUS WITH CIRCUS SARASOTA
Description
The Board transferred oversight of the Sailor Circus to the Police Athletic League in January of 2004.  Since that time the Police Athletic League has continued the proud traditions of the Sailor Circus.  Recent conversations between School Board staff, the Sheriff, and Circus Sarasota have led to a model that would change this relationship from the Police Athletic League having oversight of Sailor Circus to Circus Sarasota taking that role.  Circus Sarasota is a long standing and well respected organization with both professional circus performers and a leadership structure that will benefit the students and staff of the Sailor circus for years to come.  These agreements establish the circumstances and operating procedures under which that relationship will be executed.  Note that the agreement includes both a commitment to the traditions of the Sailor Circus and a commitment to enrollment and performances.

Recommendation
That the Board approve the lease agreement and operating agreement between the School Board and Circus Sarasota, Inc., as presented.
